Environmental groups to file suit against USACE over endangered plant

Environmental groups, including American Rivers, Sierra Club, National Audubon Society and Healthy Gulf, have notified the U.S. Army Corps of Engineers of their intent to file suit on the basis that the proposed Yazoo Backwater Pumping Project violates the Endangered Species Act.

At issue is the pondberry plant, which is listed as an endangered species. The group claims that the Corps failed to consult with the U.S. Fish and Wildlife Service in regards to the pondberry being impacted. Mississippi is one of seven southern states in which the pondberry grows.

The Corps has 60 days to respond to a notice of intent to file suit.
